SpotSaver LLC (“SpotSaver”, “we”, “us” or “our”) provides a parking and spot reservation platform through our website at www.myspotsaver.com and app.myspotsaver.com (the “Website”), our mobile application (the “Application”), and any related products and services (collectively, the “Services”). These Terms of Use (“Terms”) govern your access to and use of the Services. Please read these Terms carefully. This is a legally binding agreement between SpotSaver and you. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT ACCESS OR USE THE SERVICES. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

ELIGIBILITY

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use the Services. By using the Services, you represent and warrant that you meet this requirement and that the information you provide to us is accurate and complete.

ACCOUNTS AND REGISTRATION

To use certain features of the Services, you must create an account by providing information such as your email address or mobile phone number and a password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

USE OF THE SERVICES

SpotSaver grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms. You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with the operation of the Services, using the Services for any unlawful purpose, or reproducing, distributing, or creating derivative works from any part of the Services without our prior written consent.

BOOKINGS AND PAYMENTS

The Services allow you to search for, reserve, and pay for parking spots and related offerings. You are responsible for ensuring that the details of any reservation are correct before confirming it. Payments are processed through our third-party payment processors, and you agree to their terms in addition to these Terms. Fees, availability, and cancellation rules may vary and will be presented to you at the time of booking.

SMS / TEXT MESSAGING PROGRAM

SpotSaver offers an SMS messaging program (the “Program”) that allows users to receive text messages related to their use of the Services. By providing your mobile phone number and opting in, you agree to the following terms for the Program:

Program Description

When you opt in, SpotSaver will send you transactional booking notifications (such as booking confirmations, reminders, expirations, and completions) and, where you have consented, promotional messages about offers and updates. Two-factor authentication and account verification codes are provided as part of account security.

Opt-In

You opt in to the Program by entering your mobile phone number and checking the SMS consent checkbox during account registration in the Website or Application. Your consent is not a condition of purchasing any goods or services.

Message Frequency

Message frequency varies based on your activity and use of the Services.

Cost

Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.

Opt-Out

You can cancel the Program at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a confirmation message, and you will no longer receive SMS messages from that program. To rejoin, reply START or opt in again through the Website or Application.

Privacy

INTELLECTUAL PROPERTY

The Services, including all content, features, functionality, logos, and trademarks, are owned by SpotSaver or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use SpotSaver’s trademarks, logos, or other proprietary materials without our prior written permission.

USER CONTENT

You retain ownership of any content you submit through the Services. By submitting content, you grant SpotSaver a non-exclusive, worldwide, royalty-free license to use, host, store, and display that content solely as necessary to operate and provide the Services. You are solely responsible for the content you submit and represent that you have the necessary rights to do so.

THIRD-PARTY SERVICES AND LINKS

The Services may contain links to or integrations with third-party websites, applications, or services that are not owned or controlled by SpotSaver. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SpotSaver does not warrant that the Services will be uninterrupted, secure, or error-free.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SpotSaver AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

INDEMNIFICATION

You agree to indemnify and hold harmless SpotSaver and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

TERMINATION

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the United States and the state in which SpotSaver LLC is organized, without regard to conflict of law principles.

CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
